The Ministry of Information, Communications and the Arts ("MICA") would like to seek feedback on the proposed amendments to the Telecommunications Act ("TA").

The TA spells out the powers of the Infocomm Development Authority of Singapore ("IDA") and the rights and duties of telecommunication licensees and persons involved in the provision of telecommunication services in Singapore.

MICA, together with the IDA, has reviewed the TA, and is proposing amendments to refine the Government's existing powers and ensure that the legislative framework is up-to-date. Revisions to the TA seek to ensure that it remains relevant and sufficient to regulate the rapidly changing telecom industry while encouraging vibrancy and competition in the sector.

The proposed amendments include the control of critical telecom infrastructure and licensees, where it is recommended that the TA be amended to provide the Minister with the powers to ensure the continuity of telecom services, as well as the inclusion of new concepts and business models to provide greater clarity on the scope of consolidation provisions and ensure consistency with other existing legislations. Parties that submit comments on this Consultation Document should organise their submissions as follows: (a) cover page (including their personal/company particulars and contact information); (b) table of contents; (c) summary of major points; (d) statement of interest; (e) comments; and (f) conclusion. Supporting material may be placed in an annex.

MICA reserves the right to make public all or parts of any written submission and to disclose the identity of the source. Commenting parties may request confidential treatment for any part of the submission that the commenting party believes to be proprietary, confidential or commercially sensitive. Any such information should be clearly marked and placed in a separate annex. If MICA grants confidential treatment it will consider, but will not publicly disclose, the information. If MICA rejects the request for confidential treatment, it will return the information to the party that submitted it and will not consider this information as part of its review. As far as possible, parties should limit any request for confidential treatment of information submitted. MICA will not accept any submission that requests confidential treatment of all, or a substantial part, of the submission.
