OpenNet's Submission of Clean Copy of Schedules 1 and 2 of ICO

On 11 August 2011, OpenNet submitted a clean copy of Schedules 1 and 2 of OpenNet's ICO incorporating IDA's 5 August 2011 Directed Amendments. OpenNet has also included clauses 5.11(c) and 5.10(c) in Schedules 1 and 2 respectively to clarify the operations of 5.11 and 5.10 in the two respective ICO schedules.

IDA's Direction to OpenNet in Relation to OpenNet's Proposed Remedy Framework for Errors in Mandated Services Information

On 5 August 2011, IDA directed OpenNet to incorporate specific drafting language ("Directed Amendments") in its proposed modifications to the Mandated Services Information ("MSI") Remedy framework in Schedules 1 and 2 of its Interconnection Offer ("ICO"). OpenNet's proposed modifications incorporating the Directed Amendments have been approved by IDA and will take effect from 5 August 2011.

IDA also issued its decision on OpenNet's reconsideration request dated 27 June 2011. OpenNet had requested IDA to reconsider certain aspects of IDA's direction dated 13 June 2011. After careful consideration of the issues raised by OpenNet in the reconsideration request, IDA has decided to vary IDA's 13 June 2011 direction as follows:-

  • Where OpenNet is informed of a MSI error or inaccuracy by third parties, OpenNet shall notify its Qualifying Persons of the MSI error or inaccuracy and inform them of the correct MSI within three (3) business days of being informed of the MSI error or inaccuracy, instead of within one (1) business day as previously required by IDA.
  • Further, where OpenNet discovers or is informed of a MSI error or inaccuracy, OpenNet shall correct/rectify such errors or inaccuracies as soon as reasonably practicable instead of within one (1) business day as previously required by IDA.

In coming to the above decision, IDA took into consideration OpenNet's submission that where it is informed of an MSI error or inaccuracy by third parties, OpenNet will require some time to verify the information provided. With regard to the timeframe for rectification of MSI errors or inaccuracies, IDA recognises that where it is necessary for OpenNet to carry out network rectification as part of the rectification of MSI errors or inaccuracies, OpenNet may require more time to rectify the MSI error or inaccuracy in the MSI database as it is necessary for the actual site deployment to be rectified before the MSI database can be updated.

Request by OpenNet for Reconsideration of IDA's Direction Dated 13 June 2011 In Respect of OpenNet's Mandated Services Information

On 27 June 2011, OpenNet Pte Ltd ("OpenNet") submitted a request for IDA to reconsider certain aspects of IDA's Direction dated 13 June 2011 which had required OpenNet to modify particular provisions of its proposed Interconnection Offer ("ICO") Schedule 1 (Residential End-User Connection) and Schedule 2 (Non-Residential End-User Connection).

Following the industry consultation on OpenNet Pte Ltd's ("OpenNet") proposed remedy framework for erroneous or inaccurate Mandated Services Information ("MSI") as proposed in Schedule 1 (Residential End-User Connection) and Schedule 2 (Non-Residential End-User Connection) of OpenNet's Interconnection Offer ("ICO"), IDA has directed OpenNet to modify the proposed framework in its ICO. OpenNet will have to submit to IDA a revised proposed Schedule 1 and Schedule 2 of its ICO that incorporates the IDA directed modifications by 27 June 2011.

Under Section 2.2 of the NetCo Interconnection Code 2009, OpenNet, the Next Generation Nationwide Broadband Network ("Next Gen NBN") NetCo, is required to ensure that the Mandated Services Information ("MSI") it provides, including network coverage information, enables OpenNet's Qualifying Persons ("QPs") to: (a) understand the process for the provisioning and use of Mandated Services available to that QP; and (b) make an informed decision as to the Mandated Services ordered and related options available to the QPs.

In recognition of the importance of the accuracy and reliability of the MSI provided by OpenNet, IDA has required OpenNet to propose a remedy framework in the OpenNet Interconnection Offer ("ICO") to provide remedies to QPs who have relied on OpenNet's erroneous or inaccurate MSI to submit requests for service to OpenNet.

IDA hereby invites interested parties to submit written comments regarding OpenNet's proposed remedy framework for erroneous or inaccurate MSI as proposed in Schedule 1 (Residential End-User Connection) and Schedule 2 (Non-Residential End-User Connection) of OpenNet's ICO.
