IDA's Direction to Nucleus Connect in Relation to Nucleus Connect's Proposed Remedy Framework for Errors in Mandated Services Information

On 4 May 2012, IDA directed Nucleus Connect to incorporate specific drafting language ("Directed Amendments") to its proposed modifications to the Mandated Services Information ("MSI") Remedy framework in the General Service Terms and Conditions of its Interconnection Offer ("ICO"). Nucleus Connect's proposed modifications incorporating the Directed Amendments have been approved by IDA and have taken effect from 4 May 2012.

IDA also issued its decision on Nucleus Connect's reconsideration request dated 13 March 2012. After careful consideration of the issues raised by Nucleus Connect in the reconsideration request, IDA has decided to uphold IDA's 28 February 2012 direction in its entirety.

Request by Nucleus Connect for Reconsideration of IDA's Direction Dated 28 February 2012 In Respect of Nucleus Connect's Mandated Services Information

On 13 March 2012, Nucleus Connect Pte Ltd ("Nucleus Connect") submitted a request to IDA to reconsider certain aspects of IDA's Direction dated 28 February 2012 which had required Nucleus Connect to modify particular provisions of the proposed General Service Terms and Conditions of Nucleus Connect's Interconnection Offer ("ICO").

Following the industry consultation on Nucleus Connect Pte Ltd's ("Nucleus Connect") proposed remedy framework for erroneous or inaccurate Mandated Services Information ("MSI") as proposed in the General Service Terms and Conditions of Nucleus Connect's Interconnection Offer ("ICO"), IDA has directed Nucleus Connect to modify the proposed framework in its ICO. OpenNet will have to submit to IDA a revised proposed General Service Terms and Conditions of its ICO that incorporates the IDA directed modifications by 13 March 2012.

Under Section 2.2 of the OpCo Interconnection Code 2009, Nucleus Connect Pte Ltd, the Next Generation Nationwide Broadband Network ("Next Gen NBN") OpCo, is required to ensure that the Mandated Services Information ("MSI") it provides enables Nucleus Connect's Qualifying Persons ("QPs") to: (a) understand the process for the provisioning and use of Mandated Services available to that QP; and (b) make an informed decision as to the Mandated Services ordered and related options available to the QPs. In recognition of the importance of the accuracy and reliability of the MSI provided by Nucleus Connect, IDA has required Nucleus Connect to propose a remedy framework in the Nucleus Connect Interconnection Offer ("ICO") to provide remedies to QPs who have relied on Nucleus Connect's erroneous or inaccurate MSI to submit requests for service to Nucleus Connect. IDA hereby invites interested parties to submit written comments regarding Nucleus Connect's proposed remedy framework for erroneous or inaccurate MSI as proposed in the General Service Terms and Conditions schedule of Nucleus Connect's ICO.
