INFORMATION CIRCULAR IN RESPECT OF THE CROSS-CARRIAGE MEASURE: SUMMARY OF THE DIRECTION TO SINGNET TO CROSS-CARRY THE BARCLAYS PREMIER LEAGUE CONTENT

Dated: 27 September 2013

1.       On 24 April 2013, in exercise of its powers under section 26(1) of the Media Devel​opment Authority of Singapore Act (Cap. 172), the Media Development Authority of Singapore (“MDA”) determined that the Barclays Premier League Live Package Content (the “BPL Content”) constitutes Qualified Content pursuant to Paragraph 2.3(d)(i)(B) of the Code of Practice for Market Conduct (the “Code”) with effect from 21 December 2012 and issued a Direction to SingNet Pte Ltd (“Sin​gNet”) to comply with its duties as Supplying Qualified Licensee for the Barclays Premier League Live Package Content under Paragraph 2.7 of the Code.

2.       On 8 May 2013, SingNet submitted its appeal to the Minister to set aside the Direction (the “App​eal”). On 26 July 2013, the Minister rejected the Appeal and up​​held the Dire​ction.

3.       In light of the public interest, MDA has decided to publish a summary of the Direction. The summary o​f the Direction can be accessed at this link (909.27KB)​.

4.       In considering whether to publish a decision (and the form of such a decision), and the extent of the information to be published, MDA will do so based on the likely seriousness of the regulatory issues concerned, the potential impact on the industr​​​y and consumers, and the precedent value of such publication. Depending on the relevant circumstances, MDA may or may not publish its regulatory decisions relating to the implementation and enforcement of the Code.
