IDA invites the industry and public to provide feedback and comments on SingTel's request. Notes to Editors:

1 SingTel's request to be granted an exemption from dominant licensee regulatory requirements in international telephone services is in accordance with the Code of Practice For Competition in the Provision of Telecommunication Services (the 'Code'), Section 2.6.1. A Dominant Licensee may submit an application to IDA, identifying the specific provisions of the Code that it wishes to be exempted from. The Dominant Licensee must demonstrate that its adherence to such provisions is not necessary to protect end users or promote and preserve effective competition amongst Licensees. The Dominant Licensee must provide verifiable data to support its request. The Code can be found at https://www.imda.gov.sg/, under the sections "Policies & Regulation", "Codes of Practice & Guidelines".

2 A Licensee will be classified as dominant if it controls facilities that provide a direct connection to end users within Singapore, regardless of the technology used, and: (a) the facilities are sufficiently costly or difficult to replicate, such that it would create a significant market entry barrier to competitors; or (b) the Licensee has the ability to restrict output or to raise prices above competitive levels, over such facilities, for telecom services provided by end-users.

3 The specific regulatory requirements can be found in IDA's public consultation paper, or the Code at https://www.imda.gov.sg/, under the sections "Policies & Regulation", "Codes of Practice & Guidelines".
