The Infocomm Development Authority of Singapore (IDA) has today issued a public consultation paper on 'Request of Singapore Telecommunications Limited (SingTel) for exemption1 from Dominant Licensee2 obligations3 with respect to the International Capacity Services market'.

IDA invites the industry and public to provide feedback and comments on SingTel's request. IDA also welcomes the submission of any factual information that may assist IDA in determining whether SingTel's dominant licensee obligations in International Capacity Services (ICS) is necessary to protect end-users and/or promote and preserve effective competition in the market.

The consultation exercise is in line with IDA's on-going efforts to engage the public in its decision-making process and to increase regulatory transparency. All views and comments should be submitted in writing to reach IDA not later than 12 noon (Singapore time), 15 April 2004. IDA will consider all submitted inputs and will issue a preliminary decision for public comments, where appropriate, before issuing its final policy decision.

1Under Section 2.6 of the Code of Practice for Competition in the Provision of Telecommunications Services (the 'Code'), a Dominant Licensee may submit a request to IDA to exempt them from specific Dominant Licensee provisions and requirements. The Dominant Licensee must demonstrate that its adherence to such provisions is not necessary to protect end users or promote and preserve effective competition amongst Licensees. The Dominant Licensee must provide verifiable data to support its request. The Code can be found at https://www.imda.gov.sg/ under the sections "Policy & Regulation", "Codes of Practice".

2According to the Code, a Licensee will be classified as dominant if it controls facilities that provide a direct connection to end users within Singapore, regardless of the technology used, and: (a) the facilities are sufficiently costly or difficult to replicate, such that it would create a significant market entry barrier to competitors; or (b) the Licensee has the ability to restrict output or to raise prices above competitive levels, over such facilities, for telecom services provided by end-users.
